These Terms and Conditions apply to your use of Homi AI, including any software you download, services you access, features you use and content provided by us—whether through our website, platform or any associated products. Homi AI is operated by The E Group Payments Pty Ltd (ABN: 77 609 198 389), located at 72 Crosby Road, Albion, Queensland 4010, Australia.
By accessing or using any part of our services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.
Use of our services is subject to your acceptance of these Terms. You must have the legal capacity and authority to enter into these Terms on behalf of yourself or your organisation.
Account creation and access
Eligibility. To use Homi AI, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By creating an account, you confirm that you meet these requirements.
Creating your Homi AI account. Access to certain features, services or content within Homi AI requires an account. To create one, you must:
- Complete the sign-up form accurately;
- Choose a subscription and process payment;
- Accept these Terms and Conditions.
You agree to provide accurate, current and complete information when creating your account and to keep this information up to date.
We may use the contact information linked to your account to communicate service updates, legal notices or important account-related information. These communications are deemed received and form part of your use of our services.
Login credentials and access. Upon account creation, Homi AI will provide you with a username and password to access your account. These credentials are unique to you and must not be shared with others. If your organisation has multiple users, each user will be assigned individual credentials. Sharing login credentials across users is strictly prohibited.
You and your authorised users are responsible for maintaining the confidentiality and security of all login credentials and related account information.
You must promptly notify us at support@homiai.com.au in the following circumstances:
- If any login credentials are disclosed, lost or used without authorisation
- If a user leaves your organisation
- If a user’s role within your organisation changes
- If a user’s access rights are revoked for any reason
We may restrict or revoke access at our discretion if we suspect unauthorised use or a breach of these responsibilities.
Multiple users and organisations. Clients may create and manage multiple organisations within Homi AI, and grant access to additional users as needed. Each authorised user is considered to be acting on behalf of the client. If there’s any uncertainty about a user’s authority, we may restrict access until verification is confirmed. You are responsible for all activity under your account, including any actions taken by authorised users. You must not share your account login details, Homi AI API key or credentials with anyone who is not authorised to act on your behalf.
If you suspect any unauthorised access or suspicious activity in your account, notify us immediately at support@homiai.com.au.
Closing your account. You may close your account at any time by contacting us at support@homiai.com.au. Please note, any outstanding subscription obligations or fees may still apply.
Use of our services
You must not use Homi AI:
- In any way that violates Australian laws or regulations
- To reproduce, resell or redistribute the services without written permission
- To develop, train or enhance any competing AI product or service
- To reverse engineer, decompile or attempt to extract the source code, unless allowed by law
- To monitor, benchmark or test Homi AI for competitive purposes
- To gain unauthorised access to any systems, data or networks
- In a way that infringes the intellectual property or privacy rights of others
- To introduce viruses, malware, or disrupt or harm the services in any way
We reserve the right to suspend or terminate your access to Homi AI if you breach these conditions and may take legal action where appropriate.
Licence to use our services
Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sub-licensable licence to access and use Homi AI and its features, solely for your internal business purposes.
This licence allows you and your authorised users to:
- Collect, store and organise your business data
- Generate reports based on that data
- Add new users and manage their access
- Assign activities and customise available features
- Modify or delete your own data
- Receive reasonable support and guidance from our team on using the services
We may modify, suspend or terminate any part of the services at any time without prior notice. You must not use the services in a way that interferes with their proper operation, availability or security.
Restrictions on use
All authorised users may use Homi AI and its services only within the scope, methods and purposes outlined in these Terms and in accordance with applicable law. The following activities are strictly prohibited:
- Using Homi AI or any part of its services to commit any unlawful act, breach applicable laws, or encourage others to engage in illegal activities;
- Copying, duplicating, distributing, modifying, adapting, hacking, creating derivative works from, decompiling or attempting to extract the source code of Homi AI services;
- Without prior written consent from Homi AI, selling, reselling, leasing, licensing, sublicensing, distributing, providing, disclosing or otherwise granting access to Homi AI, in whole or in part, to any third party other than authorised users within the same client organisation;
- Using Homi AI beyond the intended scope or purposes for which it was designed;
- Accessing or interacting with Homi AI through automated programs, scripts or bots that send automatic queries or requests, unless expressly permitted by Homi AI.
Modifications to our services
Homi AI reserves the right to modify any part of the services at any time without prior notice, including but not limited to:
- Changing fees at any time, with notice to the client if such changes may affect existing subscriptions upon renewal. If fees are not collected, we may, at our sole discretion, retry collection later and/or suspend or cancel the account with prior notice.
- Rebranding Homi AI services at our sole discretion.
- Temporarily or permanently discontinuing any service or part of the platform.
- Taking necessary actions to protect Homi AI’s rights in response to any use of the services that may reasonably be viewed as infringement of intellectual property rights, or involving viruses, malware or other harmful or illegal activities.
If the client does not accept any modifications, they must notify Homi AI. Continued use of the services after changes take effect will be deemed acceptance of the modifications. Homi AI will not be liable for any modification, suspension or discontinuance of the services or any part of them.
Data processing contract
Homi AI provides a platform where the client, as data controller, can collect, store and organise personal data of data subjects as determined by the client. The platform is designed to create AI Agents and Workflows, but the client controls how the platform is used. Data usage depends on the subscription package and applicable limitations.
Duration. Homi AI will process data on behalf of the client until termination of services under these terms. After termination, Homi AI will retain the client’s data for 2 years to allow account reactivation and service resumption if requested.
Cloud-based storage. Subject to these terms and payment of applicable fees, Homi AI will not use data stored in cloud systems to train language models or for any other purpose beyond providing services to the client. All data stored remains strictly confidential.
Intellectual property rights
Homi AI retains full ownership of all intellectual property rights related to the services. The client is granted a limited, non-exclusive, non-transferable licence to use the services solely for its internal business purposes. This licence does not grant any ownership rights, and all use must comply with these terms and conditions.
Third-party services and links
Our services may use or be used in connection with third-party content, tools or integrations. Homi AI is not responsible for any loss or damage that may result from your use of these third-party services and we make no warranties or representations about them. Your use of any third-party content or services is at your own risk and subject to their own terms and policies.
Technical support
Homi AI will provide reasonable technical support to clients and their authorised users upon request. We aim to respond to support enquiries as promptly as possible during business hours.

Termination
We may suspend or terminate your access to Homi AI at any time without prior notice if we reasonably believe you’ve breached these Terms or your conduct poses harm to us, other users or the integrity of our services.
Your access to the services begins on the date you accept these Terms and continues for the initial one-year term. Either party may choose to renew or terminate the agreement at the end of the term by giving at least 30 days’ written notice.
Upon termination, you must stop using the services and either return or securely destroy any confidential information you’ve received from us.
Pre-Termination. Either party may terminate this agreement at any time with written notice if:
- The other party breaches a material term and does not remedy it within 30 days of being notified in writing;
- The other party becomes insolvent, enters administration or receivership or makes an assignment for the benefit of creditors;
- Bankruptcy or insolvency proceedings are filed by or against the other party and not resolved within 60 days.
Fees and payment
Fees for access to Homi AI are based on the selected subscription plan. Allocated Homi AI credits renew monthly, and any unused credits will roll over to the next month.
Homi AI credits top-up. Fees for using Homi AI are outlined on your invoice. Subscriptions are generally set on a monthly or annual basis and will renew for the same term, provided we receive your notice of renewal.
Unless otherwise stated on your invoice, all fees are payable at the beginning of each subscription term or as specified in the invoice, and in the currency stated.
Rights and responsibilities
Homi AI ensures that any authorised individuals who process personal data have committed to confidentiality. We will provide all necessary information to demonstrate compliance and support audits or inspections requested by you as the data controller. These audits will be conducted at your own expense.
Disclaimer of warranties, limitations of liability and indemnity
Homi AI strives to provide reliable services and continually works to improve them. However, the services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Homi AI makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, reliability, security or non-infringement.
Homi AI expressly disclaims any liability for indirect, incidental, consequential or punitive damages arising out of or in connection with these Terms or the use of the services. Under no circumstances will Homi AI’s total liability exceed the total fees paid by the client under this agreement. This limitation applies regardless of the claim’s nature, whether in contract, tort or otherwise and survives termination of this agreement.
You agree to indemnify, defend, and hold harmless Homi AI, its affiliates, officers, employees, agents and licensors from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your use of the services, violation of applicable law or infringement of any third-party rights.
Privacy
We care about your privacy. Your use of our website and services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. Please read it to understand how your data is handled.
Governing law
These Terms are governed by the laws of Queensland, Australia and any legal proceedings arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in that state.
Dispute resolution
The parties will use their best efforts to resolve any dispute, controversy or claim arising out of or relating to these Terms through good faith negotiations. If the dispute cannot be resolved through negotiation within a reasonable time, the parties agree to submit the matter to the exclusive jurisdiction of the courts of Queensland, Australia.
Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be removed, and the rest will remain in full effect.
Miscellaneous
These Terms, along with our Privacy Policy and any other legal notices on our website, form the entire agreement between Homi AI (operated by The E Group Payments Pty Ltd) and you regarding your use of our website and services.
Some services or programs offered by Homi AI may have additional terms and conditions. Where applicable, those will apply in addition to these Terms.
Updates to These Terms
We may modify these Terms and Conditions from time to time to reflect changes in our services, operations, or legal obligations. When updates are made, the revised Terms will be published on our website with the updated effective date.
By continuing to use Homi AI after any changes are published, you acknowledge and agree to the updated Terms. If you do not accept the revised Terms, please discontinue use of our services.
